These Terms of Service ("Terms") govern your access to and use of the FusionTechMark website and software engineering consulting services. By accessing our site or contracting our services, you agree to be bound by these Terms.
1. Engineering Engagements
All custom software development, systems architecture, and consulting engagements are executed pursuant to written Statements of Work (SOW) or Master Services Agreements (MSA) detailing project scope, milestone deliverables, acceptance criteria, and fee structures.
2. Intellectual Property Rights
Unless otherwise specified in a formal Master Services Agreement:
- Client Custom Work: Upon full payment of milestone fees, all proprietary custom code, schemas, and workflows engineered specifically for the client belong exclusively to the client.
- Pre-Existing Frameworks: General-purpose open-source libraries, utility helpers, and proprietary tooling used by FusionTechMark remain the property of their respective owners or FusionTechMark.
3. Limitation of Liability
In no event shall FusionTechMark be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our website or services.
4. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws without regard to conflict of law principles.
